  代驾注意事项　　
  在进行代驾服务前，代驾公司与顾客之间应该签一份合同，以构成委托合同关系。这是非常重要的一个环节。一般来说，酒后（除严重醉酒）并不丧失民事行为能力，合同是有效的。双方应在合同中明确代驾服务的车辆情况（包括车险情况）、出发地和目的地、收取金额等内容，约定发生事故等方面的相关责任等。 　　按照《道路交通法》的规定，发生交通事故，承担责任的应该是驾驶员，因此，代驾司机应当承担责任。因为，消费者请人代驾的目的就是要对方将自己安全送达目的地，代驾司机在服务中发生交通事故，应视其违约，由此造成的损失应当由代驾司机以及代驾公司承担。 　　对于车内物品丢失，首先要考虑的是报案。双方在开始服务之前应该对车内物品共同确认一下，以免说不清楚。如果双方就车内物品的看管问题有事先约定，应当根据约定确定责任主体；如果没有约定，确定车内物品丢失的时间就十分重要了。车内物品如果是在代驾司机服务期间丢失的，应由代驾司机负责赔偿。
